1. Introduction

Welcome to the Lancs Property website. If you continue to browse and use this website you are agreeing to comply with, and be bound by the following terms and conditions of use, which together with our privacy policy govern this website.

1.1 This agreement is made between ’you’ the user or viewer of our website and “we” or “us”, Lancs Property.

1.2 By entering into this agreement and advertising on the Lancs Property website you are confirming that you have read, understood and accept these Terms and Conditions.

1.3 You agree to Lancs Property publishing your advert on its website.

1.4 These terms and conditions may be subject to change at any time.

Seller Responsibilities

2.1 You agree to Lancs Property publishing your advert details on www.lancsproperty.co.uk, Fish4homes.co.uk, propertyfinder.com and any other property advertising websites we deem appropriate for advertising your property. Lancs Property may withdraw membership from any associated property portals without notice to sellers at any time.

2.2 You are over the age of 18, and have the legal right to sell or rent out the property described in the advert without requiring the permission of any other people.

2.3 You have permission from the copyright owner of any photographs or text used in your advert. Lancs Property accepts no liability for any breach of copyright.

2.4 If you have also agreed a contract with an estate agent to sell or let your property you have understood the contracts terms and conditions regarding any fees or commission payable on the sale of the property. If it is found that you are legally bound to pay the Estate Agents commission, Lancs Property will not be liable.

2.5 The description of your property (including measurements) is true and accurate and does not mislead. Lancs Property does not accept liability for the accuracy of any information contained in your advert.

2.6 Only one property may appear in each advert

2.7 You will set your own selling or rental price for your advertised property.

2.8 You will arrange and conduct any viewing of your property. Unless explicitly agreed with Lancs Property.

2.9 You will reply to reasonable requests for information regarding your property received as a result of your advert.

2.10 You will notify Lancs Property once the advertised property is sold or rented, or should you remove it from sale.

2.11 If a self-erect ’For Sale’ or ’To Let’ board option is available and chosen, you will assemble the ’For Sale’ or ’To Let’ board complying with the local planning authority regulations.

2.12 Lancs Property will not be held responsible to yourself or your property when undertaking viewings. You are responsible for arranging and allowing viewers into your property. Sellers and letting agents allow viewers into their property at their own risk, and Lancs Property does not accept responsibility for any loss or damage to individuals or property that may occur.

2.13 It is your responsibility to keep the advert updated. Once you have agreed an offer on your property the ’property status’ should be changed to ’under offer’. A property may be removed at your request, and must be removed on completion. Failure to do so may result in a £ 25.00 admin charge. The advert will automatically be removed from the web-site within 10 weeks of its status being updated to ’under offer’.

2.14 Lettings Agents: once a tenant has been found for your property you will inform Lancs Property immediately by updating the ’property status’ on your property to ’let’. The advert will automatically be removed from the web-site within 10 weeks of its status being updated to ’let’.

Lancs Property - Our Responsibilities

3.1 We will endeavour to advertise your property on www.lancsproperty.co.uk within 24 hours of receiving the relevant cleared funds. If, for reasons beyond our control this is not possible, under no circumstances will Lancs Property be liable for the delay.

3.2 We will endeavour to advertise your property on fish4homes.co.uk and propertyfinder.com within 48 hours of receiving your property advertisement. If, for reasons beyond our control this is not possible, under no circumstances will Lancs Property be liable for the delay.

3.3 Advertisement on fish4homes.co.uk is subject to their terms and conditions. Your-Pad cannot accept responsibility for changes in these terms and conditions.

3.4 We make our best efforts to ensure your advert is available at all times.

3.5 Although we will endeavour to ensure the web-site is available at all times, Lancs Property reserve the right to take the site and/or your advert off-line without prior notice for service, maintenance or security reasons and if for other reasons we consider it necessary.

3.6 Properties that have been advertised ’until sold’ will be reviewed 6 months after they were first published on the web-site. Lancs Property reserves the right to discontinue the advert on lancsproperty.co.uk, fish4homes.co.uk and propertyfinder.com following this 6 month period.

3.7 Properties that have been advertised ’until let’ will be reviewed 6 months after they were first published on the web-site. Lancs Property reserves the right to discontinue the advert on lancsproperty.co.uk, fish4homes.co.uk and propertyfinder.com following this 6 month period.

3.8 From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

4. ’For Sale’ or ’To Let’ Boards

4.1 If you require the ’for sale’ or ’to let’ board erecting then you will be entering into a contract directly with the third party ’sign erecting agent’.

4.2 The erector will put the sign up to the best of its ability, but we will have no responsibility to you for matters arising out of the contract with the erector. We will try to ensure that the sign will be erected within 5 working days of your order. You are solely responsible to us and to other people for any damage, harm or injury that may be caused by improperly moving or re-erecting signs (such as but not limited to those signs affected by storm damage or tampering by third parties). We will accept no liability for any misuse or unsafe erection of signs or any loss of or damage to the sign and you are advised to check that your household or other insurance covers you for any such activity. lancsproperty.co.uk reserves the right to charge a fee for replacing stolen, missing, or damaged signs and/or fixings.

4.3 You are solely responsible to us and to other people for any damage, harm or injury that may be caused by personally re-erecting or re-positioning your ’For Sale’ or ’To Let’ sign.

5.Newspaper Advertisements

5.1 You agree that any description of your property that you provide for any newspaper advert is truthful and accurate and accept that you will be responsible to us, to the newspaper and to its readers for the consequences of any errors or omissions on your part.

5.2 Newspaper advertising is subject to availability with the relevant local newspaper. If demand exceeds newspaper space available we will advertise your property at the next available opportunity.

5.3 No part of any advertising fee will be refunded for any unused advertisements should your property be sold or you wish to withdraw it from sale

6 Virtual Tours/ House Doctor Service

6.1 If you opt for a virtual tour of your property, you will be entering into a contract directly with our third party virtual tour provider, Virtual360.net. You will be subject to their standard terms and conditions, a copy of which can be seen at www.virtual360.net.

6.2 If you choose to take advantage of our House Doctor service, you will be entering into a contract directly with our third party House Doctor professional. You will be subject to their standard terms and conditions, a copy of which is available on request Under no circumstances will Lancs Property be liable for any failures or complaints as a result of their service.

7. Featured Properties

7.1 Should you choose to feature your property on our home page we will endeavour to activate this request within 24 hours of receipt of cleared funds.

7.2 The featured property facility is subject to availability and will advertise properties on a rotational basis. If we cannot fulfil the request to feature your property for any reason, we will refund payment received for this facility within 5 days.

8. Home Information Packs (HIPs)

8.1 As of 1st August 2007 it is your responsibility to ensure you hold a valid HIP before advertising your property on our website.

8.2 If you choose to purchase a HIP through www.lancsproperty.co.uk you will be entering into a contract with our third party HIP providers. Lancs Property will not be held responsible for any complaints resulting from your contract with the HIP provider. Please see the HIP provider’s website for terms and conditions.

8.2 Lancs Property will not be held responsible for your failure to hold a valid HIP.

8.3 Lancs Property has the right to request a copy of your valid HIP at anytime. Failure to provide evidence of your HIP within 5 days of receipt of our request may result in the removal of your property advertisement from our website without refund or compensation.

9.We Reserve the Right to:

9.1 choose not to publish your Property. Should we decide not to publish your Property any payments that we have received from you will be refunded in full within 10 working days. We accept no liability for costs or losses incurred should we decide not to publish your Property.

9.2 postpone publication of your property details if we regard them as being unsatisfactory. In this case we reserve the right to postpone publication until your property details have been amended to meet our requirements. Our decision on whether your property details are acceptable is final.

9.3 remove your property from our web-site, without refund or compensation, should we find that you have provided false or inaccurate information.

9.4 remove listings without refund or compensation if we have reason to believe the terms of our agreement has been breached.

10. Refund of Payment

10.1 You may cancel this contract by informing Lancs Property in writing or by email within 24 hours of placing your advert.

10.2 No refund will be made after 24 hours have elapsed or after you have received an enquiry regarding your property, whichever is first.

10.3 Under no circumstances will our liability exceed the value of the advertising fee received.

10.4 This does not affect your statutory rights as a consumer.

11. General

11.1 You may not create a link to this website from another website or document without Lancs Property's prior written consent.

11.2 Your use of this website and any dispute arising out of such use of the website are subject to the laws of England and Wales.

11.3 Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

11.4 This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
